For the purpose of this Privacy Notice, “Shalimar Expert” is a mobile application to be used and referred along with other relevant Mobile Applications belonging to Shalimar Paints Limited [SA1] and shall means a set of procedure enabling the Architects and Contractors (users) of the application to inquire for Company product, to check find out loyalty programmes, offers and/or communications between company and users, of making declarations, consents while using the Application installed by the Company via mobile devices made available by the Company with access to the internet as per the Terms of Use stated separately in the Application., This Privacy Notice is applicable to any person (‘User’) who accesses or uses the Application and wherever the context so requires “you”; or “your” shall mean User and the term “we”, “us”, “our” shall mean Company.
While using our applications and more generally “Shalimar Expert”, we appreciate that you are trusting us with your personal information. We are committed to respect the privacy of every person who shares personal information with us including their name, address, phone number, email address, date of birth, bank account information, company, designation and any other descriptive information that you may provide about yourself and/or that may be used to identify such individual through the Application and Sales Application (Platform) or through our authorised third-party partners. The Purpose of this Privacy Notice is to explain to you in the clearest way possible what information we collect, how we collect, use, store, process, deal, handle, retain, transfer or share your personal information through our Platform, products, services, online website and Applications that reference this Privacy Notice. The Policy may be subject to further changes and time to time amendments. As and when the Policy get amended, we may update the revised policy along with revised date on the Platform. We hope you take some time to read it carefully, will regularly check updates of this policy to appraise yourself of any updates. This Privacy Notice applies to all information collected through our Platform. If there are any terms in this Privacy Notice that you do not agree with, please discontinue use of our Services immediately. The policy is incorporated into and is subject to the Terms of Use. This Policy is applicable to all persons including users who visit, access and/or avail of the Platform and our services as defined in the Terms of Use.
By providing us your Personal Information including but not limited to sensitive Personal Information, you hereby Consent to the collection, storage, use, disclosure, processing, dealing, handle, retain, share and transfer of such information (whether in India or outside India) and represents that you have taken necessary consents from such persons on behalf of whom you have shared the information with us for the purposes as disclosed in this Policy. You are Providing the information out of your free will and entitled for an option of not providing data or Personal Information sought to be collected if you do not agree with this Policy.
Personal Information disclosed by User and Its usage by Company:
We collect your personal information that you voluntarily provide to us when you register on the application, have expressed an interest in obtaining the information about us or our product and services, when you participate in activities on the application or otherwise when you contact us. The personal information that we collect depends on the context of your interactions with us and in the application, the choices you make and the products and features you use. All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information. The personal information we collect may include the following types of personal information:
· Information You Give Us: Certain Personal Information (such as your name, phone numbers, email addresses, mailing addresses, job title, contact preferences, data collected from surveys, usernames, passwords, contact or authentication data, information you provide when using our products (such as business name, business email, business address, business fax, company website etc.) financial information (such as last four digits of your debit or credit card number, billing history, billing address, card type, issuing bank, expiration date, card origin by country), bank details, profile photo and other similar information; location details, professional experience. Payment data necessary to process your payment if you make purchases such as your payment instrument number, security code associated with your payment instrument etc. We receive, encrypt and share any information you provide in relation to Company Services. You can choose not to provide certain information, but then you might not be able to take advantage of many of our Services.
· Automatic Information: We automatically collect and store certain types of information about your use of Company Services, including information about your interaction with content and services available through Company Services that may be provided by you and may be publicly available.
· Information from Other Sources: We might receive information about you from other sources, such as your Aadhar card details pertaining to address, name, DOB, father name, gender and photo, PAN Card details, GST details, bank details, updated delivery and address information from our carriers, which we will be fetching and verifying from third party verification providers based on information provided by you. We also use the information to correct our records and deliver your next purchase more easily.
Purposes To Use and share Your Personal Information:
We and/or our other Service Provider may use, collect, disclose, process, and transfer your personal information to operate, provide, develop, and improve the products and services that we offer to our users. These purposes include but not limited to usage and sharing:
· To enable the functioning of the Platform and provision of Services, as defined in the Terms of Use, through the Platform either by us or other Service Providers. Such Party and /or Service Providers are also bound by the privacy restrictions contained in the Policy;
· To provide you with related benefits and services and to engage in / carry out the activities that would enable and assist in providing you the benefits and any services arising out or by you accessing and using the Platform;
· To understand your needs (how you use our Platform, Services you like, manner of use of Services) and to bring new and improved Services to you;
· To recommend features, products, and services that might be of interest to you, identify your preferences, and personalize your experience with the Company Services.
· To contact you via SMS, email and other modes of communication in relation to Services availed/offered by you, communicate offers, promotional events, updates and news related to the Platform that may be of interest to you
· To verify the information provided by you regarding your services and conduct related background checks
· To share the information with outsourcing partners, outsourcing us to verify your identity and analysis of data; to verify your bank details by using penny drop transaction.
· To fulfil orders, deliver products and services, process payments, and communicate with you about orders, products and services, and promotional offers;
· To provide functionality, analyse performance, fix errors, and improve the usability and effectiveness of the Company Services
· To transfer information about you if we are acquired by or merged with another company or in case of change of control;
· To administer or otherwise carry out our obligations, including our obligations under the Terms of Use of the Platform;
· To respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims; and
· To investigate, prevent, or take action regarding illegal activities, suspected fraud, violations of / on the Platform or as otherwise required by law.
· To comply with laws. For instance, we collect information regarding place of establishment and bank account information for identity verification and other purposes.
· To display interest-based ads for features, products, and services that might be of interest to you. We do not use information that personally identifies you to display interest-based ads.
· To share an information or access to personal information with third party service providers to whom Company engages/ employs to perform their functions however restricted to use it for other purpose than fulfilling orders for products or services, delivering packages, sending postal mail and e-mail, removing repetitive information from customer lists, analyzing data, providing marketing assistance, providing search results and links (including paid listings and links), processing payments, transmitting content, scoring, assessing and managing credit risk, and providing customer service. Further, they must process the personal information in accordance with applicable law.
· In compliance of law, Company may share personal information and/or account details when it includes exchanging information with other companies and organizations for fraud protection and credit risk reduction; required by any enforcement authority for investigation, by court order or in reference to any legal process; for regulatory, internal compliance and audit exercise(s); to secure Company systems;
· Company may share Users’ personal information with Companies principal, subsidiary, holding company, associates or other group entities that either are subject to this Privacy Notice or follow practices at least as protective as those described in this Privacy Notice.
· In addition to the circumstances described above, we may disclose User’s personal information to enforce or protect Company rights or properties or any or all of its affiliates, associates, employees, directors or officers or when Company has reason to believe that disclosing personal information of User(s) is necessary to identify, contact or bring legal action against someone who may be violating Companies rights, whether intentionally or otherwise, or when anyone else could be harmed by such activities.
We reserve the right to record the conversations between you and Service Providers or you and other Users facilitated by the Company through the Community feature on the Platform and the calls made by you or Service Providers to you through the Company virtual phone number feature to safeguard the privacy of Users and Service Providers. The chat/messaging logs and/or call recordings may be used to ensure compliance with the Terms of Use and this Policy including to monitor and prohibit abuse, safeguard the rights of Users and Service Providers to resolve the disputes.
We may also remove all the personally identifiable information and use the rest of the anonymized data / information enlisted above for historical or statistical purposes.
You hereby consent that the collection, disclosure, storage, processing and transfer of any Personal Information or any other information as disclosed under this Policy shall not cause any loss or wrongful gain to you if the same is used for the purposes stated in this Policy.
The Platform may contain links to websites maintained by third parties. Company does not have any control over such third-party websites. You are advised to review the privacy policy and other terms of each website that you visit.
It is disclaimed that such disclosure and storage may take place without your knowledge. In that case, we shall not be liable to you or any third party for any damages howsoever arising from such disclosure and storage. Other than as set out above, you will receive notice when personal information about you might be shared with third parties, and you will have an opportunity to choose not to share the information.
Use of Cookies and Other Identifiers:
To enable our systems to recognize your browser or device such as the pages you visit, some of the searches you perform, your browser type, IP address and to provide and improve the contents offered through the Platform and to compile aggregate statistics for internal, market research purposes, we may install cookies and other identifiers. Cookies may collect the domain name of the user, your internet service provider, your operating system, and the date and time of access. Cookies are unique identifiers that we transfer to your device to enable our systems to recognize your device and to provide numerous features that require remembering who you are. We will ask your consent for our cookies if we are legally obliged to do so. The maximum retention period of our cookies is 2 (two) years. For further information please refer our Cookies Notice.
A cookie is a small text file that seeks permission to be placed on your computer’s hard drive for record-keeping purposes. Once you agree, the file is added, and the cookie helps analyse web traffic or lets you know when you visit a particular site. Cookies allow web applications to respond to you as an individual. The web application can tailor its operations to your needs, likes and dislikes by gathering and remembering information about your preferences. We use cookies to save your time while using the Application, remind us of who you are, and track and target your interests in order to provide a customized experience. Cookies also allow us to collect non-personally identifiable information from you, like which pages you visited and what links you clicked on. Use of this information helps us to create a more user-friendly experience for all visitors. In addition, we may use third party advertising companies to display advertisements on our application. As part of their service, they may place separate cookies on your electronic devices. We have no access to or control over these cookies. This Privacy Notice covers the use of cookies by our application only and does not cover the use of cookies by any advertiser. Most browsers automatically accept cookies, but you may be able to modify your browser settings to decline cookies. Most cookies have an expiration date. This means, that they will automatically expire after a certain period and no longer register any data concerning your visit of our application. Another option is to remove the cookies manually before the expiration data.

However, if you decline or delete these cookies, some parts of the Application may not work properly, or you may not be able to use all functionality of your browser software. Personal information cannot be collected via cookies, however, if you previously provided personally identifiable information, cookies may be tied to such information. Refer to Appendix 4 to see the cookies we use. We may obtain the services of outside parties to assist us in collecting and processing the information described in this section.
Session Data: We may automatically log generic information about your device's connection to the internet, which we call "session data", that is anonymous and not linked to any personal information. Session data consists of information such as the IP address, operating system, type of browser software being used by you and the activities conducted by you on our application. An IP address is a number that lets devices attached to the internet, such as our web servers, know where to send data back to the user, such as the pages of the site the user wishes to view. We collect session data because it helps us to analyse things such as the items visitors are likely to click on most, the manner in which visitors click preferences on our application, number of visitors surfing to various pages on the site, time spent by the visitors on our application and frequency of their visit. It also helps us diagnose problems with our servers and lets us better administer our systems. Although such information does not identify any visitor personally, it is possible to determine from an IP address a visitor's Internet Service Provider (ISP), and the approximate geographic location of user’s point of connectivity.
Other Tracking Devices: We may use other industry standard technologies like web beacons to track your use of our applications and promotions, or we may allow our third-party service providers to use these devices on our behalf. Web beacons are tiny graphic images placed on certain pages on our application, or in our emails that allow us to determine whether you have performed a specific action. We may incorporate events to customise the requirement in future.
Security of Personal Information Shared:
We design our systems with your security and privacy in mind. We take necessary steps, within limits of commercial viability and necessity, to ensure that the User’s information is secure. We have adopted reasonable security practices and procedures to ensure that the Personal Information collected is secure. We also use encryption to help protect your Personal Information against unauthorized access and disclosure. We ensure that only authorized employees, agents and contractors (who have agreed to keep information secure and confidential) have access to this information.
While we will endeavour to take all reasonable and appropriate steps to keep secure any information which we hold about you and prevent unauthorized access, you acknowledge, no data transmission over the Internet can be guaranteed to be 100% secure, no electronic medium / security measure is 100% secure and that we cannot provide any absolute assurance regarding the security of your Personal Information submitted at the Platform.
Once Company receives your transmission, it makes best efforts to ensure its security in its systems by using encryption protocols and software. We maintain physical, electronic, and procedural safeguards in connection with the collection, storage, processing, and disclosure of personal customer information. Company’s security procedures mean that we may occasionally request proof of identity before we disclose personal information to you. Please keep in mind that whenever you post personal information online, that is accessible to the public, you may receive unsolicited messages from other parties. Company is not responsible for any breach of security or for any actions of any third parties that receive your Information or unintended loss, or disclosure of information caused by any unauthorized access in relation to your Personal Information. The Application is also linked to many other sites, and we are not/shall not be responsible for their privacy policies or practices as it is beyond our control. It is important for you to protect against unauthorized access to your password and to your computers, devices and applications. Be sure to sign off and close your browser window when finished using a shared computer.
You agree that such measures are secure and adequate.
Advertise:
Third-Party Advertisers and Links to Other Websites: Companies Services may include third-party advertising and links to other websites and apps. Third-party advertising partners may collect information about you when you interact with their content, advertising, and services.
Use of Third-Party Advertising Services: We provide ad companies with information that allows them to serve you with more useful and relevant ads and to measure their effectiveness. We never share your name or other information that directly identifies you when we do this. Instead, we use an advertising identifier like a cookie or other device identifier. Some ad companies also use this information to serve you relevant ads from other advertisers.
Access:
If you need to access to your Personal Information, update or correct your Personal Information (name, address, payment options, profile information, and purchase history) in your account at the Application, for any reason, you may do so by writing to us at feedback@shalimarpaints.com, and your Personal Information will accordingly be updated / corrected on a real-time basis.
We encourage that you to update your Personal Information as and when there are any changes. You are further responsible to ensure that the Personal Information provided by you is true and accurate. We shall not be responsible for the authenticity of the Personal Information supplied by you and you shall indemnify and hold us harmless for relying on the Personal Information provided by you in case of your breach of this Policy and in case of any loss and/or damage suffered by us arising out of our use or reliance on the Personal Information provided by you.
In the event you wish to know the names and addresses of the third parties to whom your Personal Information has been disclosed, you may request us for such information by communicating to us at feedback@shalimarpaints.com. We will make all reasonable efforts to revert to you within a reasonable period of time, with the information that you require.
Access Denial:
If you want to browse application without linking the browsing history to your account, you may do so by logging out of your account and blocking cookies on your device.
Most devices also provide Users with the ability to change device permissions (e.g., disable/access location services, contacts). For most devices, these controls are located in the device's settings menu. If you have questions about how to change your device permissions on devices manufactured by third parties, we recommend you contact your mobile service carrier or your device manufacturer.
Authorization:
Company may choose to host their data in servers located within India/outside of India. You authorize us to store, transfer, share, part with your Personal Information, across borders and from your country and jurisdiction to any other countries and jurisdictions across the world (including India), with our affiliates / agents / third party service providers / partners and other agencies for purposes specified under this Policy or as may be required by law.
Retention of Personal Information:
Company shall not retain your Personal Information after the purposes for which it is sought (as detailed in this Policy) is served or as otherwise required under any other law for the time being in force. The Personal Information shared by you shall be used only for the purpose for which it is collected and, in the manner, agreed by you. Personal Information however may remain on the servers unless otherwise deleted or purged permanently.

All notices or demands to or upon a User(s) shall be effective if either delivered personally, sent by courier, certified mail, by facsimile or email to the last-known correspondence, fax or email address provided by the User(s) to Company, or by posting such notice or demand on an area of the application.
Notice to a User(s) shall be deemed to be received by such User(s) if and when Company is able to demonstrate that communication, whether in physical or electronic form, has been sent to such User(s) or immediately upon Company’s posting such notice on an area of the application.
Updates and Revisions:
We may update this Privacy Notice from time to time. The updated version will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible. If we make material changes to this Privacy Notice, we may notify the same by prominently notification. We encourage you to review this privacy notice frequently to be informed of how we are protecting your information.
Retention Period:
The information shared with us will be retained as long as they are necessary for the use of our application. After that, we will save the details to comply with legal obligations, resolve disputes, and enforce its agreements or for other business and statistical purposes.
No Data Collection from Child and No Child Access to Application:
We do not knowingly solicit data from or market to children under 18 years of age. By using the Application, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the application. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. Limitation of Damages/Disclaimer:
The features of the Company Services are provided on an ‘as is’ and ‘as available’ basis, and Company hereby expressly disclaims any and all warranties, express or implied, including but not limited to any warranties of condition, quality, durability, performance, accuracy, reliability, merchantability or fitness for a particular purpose. All such warranties, representations, conditions, undertakings and terms are hereby excluded. Company makes no representations or warranties about the validity, accuracy, correctness, reliability, quality, stability and completeness of any information provided on or through the Company Services. Company does not represent or warranty that the manufacture, importation, distribution, offer, display, purchase, sale and/or use of products or services offered or displayed on the Company Services does not violate any third-party rights and Company makes no representations or warranties of any kind concerning any product or service offered or displayed on the Company Services. Any material downloaded or otherwise obtained through the Company Services is done at your sole discretion and risk and you are solely responsible for any damage to your computer system or loss of data that may result from the download of any such material. No advice or information, whether oral or written, obtained by you from Company Services or through or from the Company Services shall create any warranty not expressly stated herein.
Under no circumstances shall Company Services be held liable for an delay or failure or disruption of the content or services delivered through the Company Services resulting directly or indirectly from acts of nature, forces or causes beyond its reasonable control, including without limitation, Internet failures, computer, telecommunications or any other equipment failures, electrical power failures, strikes, labour disputes, riots, insurrections, civil disturbances, shortages of labour or materials, fires, flood, storms, explosions, Acts of God, natural calamities, war, governmental actions, orders of domestic or foreign courts or tribunals or non-performance of third parties. User(s) hereby agree to indemnify and save Company, its affiliates, directors, officers and employees harmless, from any and all losses, claims, liabilities (including legal costs on a full indemnity basis) which may arise from your use of the Company Services (including but not limited to the display of your information on the Company Application) or from your breach of any of the terms and conditions of this Agreement. User(s) hereby further agree to indemnify and save Company, its affiliates, directors, officers and employees harmless, from any and all losses, claims, liabilities (including legal costs on a full indemnity basis) which may arise from your breach of any representations and warranties made by you to Company
User(s) hereby further agree to indemnify and save Company, its affiliates, directors, officers and employees harmless, from any and all losses, claims, liabilities (including legal costs on a full indemnity basis) which may arise, directly or indirectly, as a result of any claims asserted by Third Party Rights claimants or other third parties relating to products offered or displayed on the Company Application of otherwise. User(s) hereby further agree that Company is not responsible and shall have no liability to it, for any material posted by others; including defamatory, offensive or illicit material and that the risk of damages from such material rests entirely with you. Company reserves the right, at its own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which event you shall cooperate with Company in asserting any available defences.
Company shall not be liable for any special, direct, indirect, punitive, incidental or consequential damages or any damages whatsoever (including but not limited to damages for loss of profits or savings, business interruption, loss of information), whether in contract, negligence, tort, strict liability or otherwise or any other damages.
Copyright Protection:
All content on the Application including graphics, text, icons, interfaces, audio clips, logos, images and software is the property of Company and/or its content suppliers and is protected by the Indian Copyright Law. The Application can be used only for the purposes as permitted by Company from time to time. Any other use, including the reproduction, modification, distribution, transmission, republication, display or performance, of the content in this Application can only be made with the express permission of Company.
Force Majeure:
We shall not be held responsible for any loss, damage or misuse of your personal information, if such loss, damage or misuse is attributable to a Force Majeure Event (as defined below).
“Force Majeure Event” shall mean any event that is beyond our reasonable control and shall include, without limitation, sabotage, fire, flood, explosion, acts of God, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, unauthorised access to computer data and storage device, computer crashes, breach of security and encryption, pandemic and epidemic.
Severability:
Company has made every effort to ensure that this Privacy Notice adheres with the applicable laws. The invalidity or unenforceability of any part of this Privacy Notice shall not prejudice or affect the validity or enforceability of the remainder of this Privacy Notice.
No waiver:
The rights and remedies available under this Privacy Notice may be exercised as often as necessary and are cumulative and not exclusive of rights or remedies provided by law. It may be waived only in writing. Delay in exercising or non-exercise of any such right or remedy does not constitute a waiver of that right or remedy, or any other right or remedy.
Governing Law and Dispute Resolution:
Terms and condition of this Privacy Notice shall be governed in all respect by the laws of Indian Territory. Company considers itself and intends to be subject to the jurisdiction only of the Courts of Delhi, India. The parties to this Agreement hereby submit to the exclusive jurisdiction of the courts of Delhi, India.
